Right of Withdrawal Information

Consumer definition: A consumer is any natural person who performs a legal act that cannot primarily be attributed to their professional or business activities.

Right of Withdrawal

You have the right to withdraw from this agreement within 30 days without providing any reason.

The withdrawal period is 30 days from the date:

  • On which you, or a third party designated by you (other than the carrier), take possession of the goods, if you ordered one or more goods under a single order and they were delivered simultaneously;

  • On which you, or a third party designated by you (other than the carrier), take possession of the last goods, if you ordered multiple goods under a single order and they were delivered separately.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this agreement. This can be done via email: support@Capemoda.com.

You may use the attached model withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send your notification regarding the exercise of the right of withdrawal before the withdrawal period expires.

Effects of Withdrawal

If you withdraw from this agreement, we will reimburse you all payments received from you, including delivery costs (except for additional costs resulting from your choice of a delivery method other than the standard delivery offered by us), without undue delay and no later than 30 days from the date we receive your withdrawal notice.

We will use the same payment method you used for the original transaction unless explicitly agreed otherwise. This reimbursement will not incur any extra fees for you.

We may withhold reimbursement until:

  • We have received the returned goods, or

  • You have provided evidence that you have returned the goods, whichever occurs first.

You must return or hand over the goods immediately, and no later than 30 days from the date you informed us of the withdrawal. The deadline is met if the goods are sent before the 30-day period expires.

The direct costs of returning the goods are your responsibility.

You are only liable for any diminished value of the goods if this is due to handling the goods beyond what is necessary to establish their nature, characteristics, and functioning.

Reasons for Exclusion and Expiration of the Right of Withdrawal

The right of withdrawal does not apply to agreements for:

  • The delivery of goods that are not prefabricated and have been manufactured based on an individual choice or decision of the consumer;

  • The delivery of goods that are perishable or have a limited shelf life;

  • The delivery of alcoholic beverages whose price was agreed upon in the contract but can only be delivered no earlier than 30 days after the conclusion of the contract, and whose value depends on market fluctuations;

  • The delivery of newspapers, magazines, or periodicals, except for subscriptions.

The right of withdrawal expires early for agreements concerning:

  • The delivery of sealed goods that are not suitable for return due to health or hygiene reasons if the seal has been broken after delivery;

  • The delivery of goods that are inseparably mixed with other goods after delivery due to their nature;

  • The delivery of audio/video recordings or computer software in sealed packaging if the seal has been broken after delivery.
